Common questions

How does maintenance for a spouse or children work in Singapore?

Both parents have a legal duty to maintain their children, usually until age 21 and sometimes longer. A husband can be ordered to maintain his wife or former wife, and a wife can be ordered to maintain an incapacitated husband. The court looks at needs, means and the family’s standard of living rather than a fixed formula.

How are matrimonial assets divided in a Singapore divorce?

The court divides matrimonial assets in whatever proportions it considers just and equitable, which is not automatically 50:50. In dual-income marriages it usually follows the structured approach from ANJ v ANK, weighing each spouse’s financial and non-financial contributions; in single-income marriages it takes a broader view of the whole marriage.
