Common questions

What is the difference between custody, care and control, and access?

Custody is about who makes the major long-term decisions for a child, such as education, religion and major medical treatment; it is usually shared by both parents. Care and control decides which parent the child lives with day to day. Access is the time the child spends with the other parent.

Will we have to go through mediation or counselling during a divorce?

If you have a child under 21, both parents must complete the Co-Parenting Programme before filing, and court-based mediation and counselling focused on the children is generally required. Beyond that, the court can direct mediation or counselling in any case, and many couples also use private mediation or collaborative practice to settle without a trial.
