Common questions

Will we have to go through mediation or counselling during a divorce?

If you have a child under 21, both parents must complete the Co-Parenting Programme before filing, and court-based mediation and counselling focused on the children is generally required. Beyond that, the court can direct mediation or counselling in any case, and many couples also use private mediation or collaborative practice to settle without a trial.

What is the difference between an uncontested and a contested divorce?

A divorce is uncontested when both spouses agree that the marriage should end and on the fact relied on; it can then usually go on the Simplified Track. If one spouse disputes the divorce, it is contested and goes on the Normal Track. Either way, any disagreements about children, assets or maintenance can still be resolved later through mediation or by the court.
